RAGE ZONE

MASTER PARTICIPATION AGREEMENT, ASSUMPTION OF RISK, INDEMNITY AND RELEASE OF LIABILITY

(Applicable to Smash Rooms, Axe Throwing, Archery, Vehicle Smash Experiences, Corporate Events and all other activities conducted by Rage Zone)

IMPORTANT NOTICE TO ALL PARTICIPANTS

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING.

This Agreement contains important legal provisions that affect your legal rights and obligations. By signing this document, you acknowledge that you have read, understood and voluntarily agree to all of its terms and conditions. Participation in activities offered by Rage Zone involves inherent and foreseeable risks that cannot be completely eliminated, even where all reasonable safety precautions are implemented. These activities include, but are not limited to, smashing objects, throwing axes, archery, vehicle smashing, team-building exercises and any other recreational or entertainment activities conducted on the premises. Participation may result in:
  • Minor injuries
  • Serious bodily injury
  • Permanent disability
  • Emotional distress
  • Property damage
  • Death
By signing this Agreement, you acknowledge that these risks have been specifically drawn to your attention and that you voluntarily choose to participate despite such risks. This notice is intended to draw your attention to the provisions of this Agreement relating to the assumption of risk, limitation of liability and indemnity, as contemplated by applicable South African law, including the Consumer Protection Act, 68 of 2008 where applicable.

1. DEFINITIONS

For purposes of this Agreement: “Rage Zone” means Rage Zone, its owners, directors, members, shareholders, employees, managers, instructors, contractors, volunteers, landlords, agents, insurers, successors and assigns. “Participant” means every person entering the premises for the purpose of participating in, observing or accompanying any activity. “Activities” include but are not limited to:
  • Smash Rooms
  • Rage Rooms
  • Axe Throwing
  • Archery
  • Vehicle Smash Experiences
  • Team Building Activities
  • Corporate Functions
  • Birthday Parties
  • School Groups
  • Spectator Areas
  • Waiting Areas
  • Parking Areas
  • Walkways
  • Any future activity conducted by Rage Zone.

2. PARTICIPANT DECLARATION

By signing this Agreement, I declare that:
  • I am participating entirely of my own free will.
  • I understand that participation is voluntary.
  • I have been given sufficient opportunity to ask questions regarding the activities and this Agreement.
  • I understand the rules applicable to the activities in which I intend participating.
  • I agree to comply with all safety instructions provided by Rage Zone employees.
  • I acknowledge that failure to comply with safety instructions may result in my immediate removal from the activity or premises without refund.

3. MEDICAL DECLARATION

I declare and warrant that:
  • I am physically capable of participating in the selected activities.
  • I am mentally capable of understanding and following safety instructions.
  • I am not under the influence of alcohol, illegal drugs or any medication that may impair my judgment, balance, coordination or reaction time.
  • I do not suffer from any medical condition that may place myself or any other participant at risk.
  • I have disclosed any relevant medical conditions to Rage Zone before participating.
I understand that participation may aggravate pre-existing injuries or medical conditions and I voluntarily accept this risk. Should I become aware of any condition affecting my ability to participate safely, I undertake to immediately notify a member of Rage Zone staff.

4. PARTICIPANT RESPONSIBILITIES

For the safety of all persons on the premises, I agree that I will:
  • Attend and listen carefully to the mandatory safety briefing.
  • Follow all instructions issued by Rage Zone staff immediately.
  • Wear all personal protective equipment (“PPE”) provided by Rage Zone for the duration of the activity.
  • Wear fully enclosed, closed-toe shoes at all times.
  • Ensure that helmets, eye protection, gloves, face shields and any other PPE are correctly fitted before participating.
  • Not intentionally misuse any equipment.
  • Not intentionally damage safety equipment.
  • Not remove PPE until instructed that it is safe to do so.
  • Refrain from horseplay, reckless conduct or behaviour that may endanger any person.
  • Respect all exclusion zones and safety barriers.
  • Immediately report any unsafe condition, damaged equipment or injury to Rage Zone staff.
  • Immediately stop participating if instructed by any member of Rage Zone staff.
I understand that Rage Zone reserves the right to refuse participation or immediately remove any Participant who fails to comply with these safety requirements.

5. ALCOHOL, DRUGS AND IMPAIRMENT POLICY

For the safety of all persons on the premises:
  • Participants may not participate while under the influence of alcohol.
  • Participants may not participate while under the influence of illegal drugs.
  • Participants may not participate while affected by medication that impairs judgment, coordination or reaction time.
  • Rage Zone reserves the absolute right to refuse participation where impairment is reasonably suspected.
Any decision made by Rage Zone staff in relation to participant safety shall be final. No refund shall be payable where participation is refused due to suspected impairment or unsafe behaviour.

6. AGE REQUIREMENTS

To promote the safety and wellbeing of all Participants, Rage Zone has implemented the following minimum age requirements for participation:

6.1 Participants Aged 18 Years and Older

Participants who are 18 years of age or older may participate independently in any Rage Zone activity, subject to compliance with this Agreement and all applicable safety rules. 18+ – Enter and unleash the chaos on your own.

6.2 Participants Aged 13 to 17 Years

Participants between the ages of 13 and 17 years are welcome to participate only if accompanied by a responsible adult (18 years or older). The accompanying adult must remain on the Rage Zone premises for the duration of the Participant’s visit and accepts responsibility for ensuring that the minor complies with all safety rules and staff instructions. In addition, the Participant’s parent or legal guardian must complete and sign the Parent/Guardian Consent section contained in this Agreement before the minor will be permitted to participate. 13–17 – Bring a responsible adult along for the experience.

6.3 Participants Under 13 Years of Age

For safety reasons, Participants under the age of 13 years are not permitted to participate in any Rage Zone activities unless expressly authorized by Rage Zone for a specific supervised event or program, their will be days allowed where kids will be able to smash plastic and their will be no sharp objects and dangerous activities around while kids are

6.4 Verification of Age

Rage Zone reserves the right to request valid identification or other reasonable proof of age before permitting any person to participate in an activity.
